Compulsory Licensing issues(NATCo vs Bayer)

Time line

1-Bayer Corporation makes Nexavar and gets patent in 2008.One leaf of 120 tabs cost 2.80 lacs.

2-Controller of Patents ,Mumbai grants compulsory licensing to Natco for its generic drug "Soro fenib Tosylate"

3-Bayers Corp. appealed against this to IPAB(Intellectual Property Apellate Board).

4-IPAB upholds compulsory license for Natco pointing out that Bayer had not made the drug available on large scale and at affordable prices.Natco to pay 7% royalty.
